What is Kreiner v Fischer? |

On July 23, 2004, Kreiner v Fischer was decided by
Michigan Supreme Court. Kreiner provides certain guidelines to
determine if a Plaintiff has a viable cause of action. This case makes
it imperative that a victim work with their treating doctor to
establish and document the medical damages, impairments and complications. |

Michigan's Wrongful Death Act also applies. An estate will be
opened and a Personal Representative will be appointed by the
court who will handle the case on behalf of the victim.
Potential Wrongful Death damages include:
- Funeral and burial expenses;
- Wages the deceased would have earned in the future;
- Payment for the services the deceased would have performed
such as Replacement Services or household chores;
- Pain and suffering from the accident before death;
- Loss of society and companionship.
